Terms of Service

By using BullionBidder you agree to these Terms. If you do not agree, do not use the service.

1. The service

BullionBidder is a tool that analyzes auction catalogs (in French, an "encan" or "vente aux enchères", the same thing) you upload, comparing lot prices to current and historical metal spot prices and dealer-retail estimates. It is provided on an "as-is" basis, free of charge for the core feature set, with optional paid tiers, Pro and Pro Plus, for power users. The app currently reads catalogs whose lot descriptions are written in English or French. Catalogs in other languages may not be read or graded correctly. Support for more languages is in progress.

2. Eligibility

You must be of legal age in your jurisdiction to enter contracts (18 in most Canadian provinces, including Quebec) and not be prohibited by applicable law from using the service.

3. Bring Your Own Data, your responsibility

You are responsible for ensuring you have the right to upload any auction catalog or other content you submit. Do not upload material that infringes copyright, contains personal information of third parties without consent, or violates the terms of the source auction house. We extract structured facts (lot weight, metal, price) from what you upload, these facts are not protected by copyright and our use of them is fair and lawful.

4. Acceptable use

You agree not to: (a) reverse-engineer, scrape, or systematically download the service; (b) use the service to harass, deceive, or harm others; (c) violate any law or third-party rights; (d) attempt to bypass technical or rate-limit controls; (e) resell or redistribute the service without our written permission.

5. Intellectual property

The BullionBidder name, logo, software, and original content are our intellectual property. You retain all rights to anything you upload, including the original catalog files (which we do not store on our servers, see Privacy Policy §3) and the personal records you create using the service (bid history entries, manual lot corrections, account preferences). By uploading, you grant us a limited, transient license to process the file's extracted text content solely to provide the service to you, for the duration of that processing. When a lot's text does not fully describe it, this also covers reading that lot's image from your uploaded catalog for the sole purpose of extracting the factual specifications the text was missing (such as weight and fineness); images are processed transiently for that purpose and are not copied, republished, or stored. You are responsible for ensuring you have the right to upload the catalog you provide. Your lot corrections stay private to your account by default. If you explicitly choose to share a correction to help improve our coin database (an optional checkbox when you make it), you grant us a perpetual, royalty-free license to use that correction's factual data (metal, weight, purity) to improve the service for everyone. Sharing a correction also sends any note you wrote and links the suggestion to your account, so our staff can review it before accepting it. Your note and that account link are used only for that review, are never shown to other users, and are deleted when you close your account. We still claim no ownership of your uploads or your personal records.

6. Not financial advice; no endorsement of dealers

BullionBidder is a research and analysis tool. Lot evaluations, deal grades, dealer-price and eBay listings lookups, and spot-price comparisons are informational only. They are not financial, investment, tax, or legal advice. Dealer prices and listings come from third parties, can change at any time, and we do not sell any product ourselves. Auction outcomes, metal prices, and resale values are unpredictable. You alone are responsible for your bidding and purchasing decisions and any losses you incur. The "where to buy" panel shows prices and listings from third-party sellers (including dealers such as Kitco and Money Metals, and eBay sellers) as a convenience, so you can compare. We may earn an affiliate commission when you click through and buy. We do NOT endorse, recommend, vet, authenticate, or guarantee any seller, their products, their pricing, their stock, or their conduct, and showing a seller is not a recommendation to buy from them. We are not a party to any transaction between you and a seller. Anything you buy is strictly between you and that seller: their prices (which may differ from what we display, and exclude shipping, taxes, and fees), availability, product authenticity and quality, shipping, returns, warranties, and any dispute are entirely their responsibility, not ours. Buy at your own risk. Before purchasing, verify the seller's reputation and the product yourself, and confirm the live price, total cost, and terms on the seller's own site. We are not responsible for any loss arising from a purchase you make through a link we provide.

7. Verify everything before you bid or buy

You must independently verify every number BullionBidder shows you before placing a real-world bid or making a purchase. The software can and will make mistakes: reader errors (mis-classifying a coin's metal, weight, or purity), out-of-date spot prices, AI errors on edge cases, false matches, eBay listing data that's stale or wrong, currency conversion errors, typos in our hand-tuned coin database, bugs in the deal-grading math. Spot prices and exchange rates come from third-party market-data providers (including Metals.Dev for metal prices, with Yahoo Finance and Stooq as backups, and Frankfurter for currency rates). We do not produce that data and are not responsible for its accuracy, delays, or outages. We make no representation that any value, grade, or recommendation is accurate. Treat the tool's output as a STARTING POINT for your own research, not as a final answer. If you're about to bid on or buy something material, double-check the lot or listing details against the original source, confirm the metal/weight/purity yourself, and compare against multiple independent sources. We are not responsible for losses caused by software bugs, parsing errors, AI mistakes, stale or incorrect third-party data, or any other defect in the service. If you bet your life savings on a deal grade we computed and it turns out we mis-parsed the lot, that loss is yours, not ours.

8. No warranty

The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including without limitation accuracy, completeness, fitness for a particular purpose, non-infringement, freedom from defects or bugs, security, or uninterrupted availability. Spot prices, FX rates, parsing results, AI extractions, retail estimates, eBay comparison data, and deal grades may be wrong, missing, stale, or misleading. We do not warrant that the service will produce correct results, that errors will be corrected, or that the service will meet your requirements. We support many catalog formats and add new ones as a courtesy, on a best-effort basis. We do not warrant that any particular catalog will parse correctly and we do not guarantee any timeframe for adding support for a format. Your sole remedy if dissatisfied is to stop using the service.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages, lost profits, lost data, or losses on auction bids, including but not limited to losses caused by software bugs, parsing errors, AI mistakes, mis-classified lots, wrong spot prices, stale FX rates, eBay data errors, or any other defect or failure of the service. Our total cumulative liability arising from your use of the service is capped at the greater of (a) CAD $50 or (b) the amount you paid us for the service in the 12 months preceding the claim. Quebec consumers' inalienable rights under the Consumer Protection Act are not affected.

10. Subscriptions, billing, and cancellation

Pro is an optional paid tier offered as a recurring subscription, billed monthly or annually in Canadian dollars (CAD). Prices shown on the pricing page are exclusive of applicable sales taxes (Quebec QST, Canadian GST/HST, and equivalent foreign value-added taxes for international users); applicable taxes are calculated and added at checkout by our payment processor, Stripe. By starting a Pro subscription you authorize us, through Stripe, to charge your payment method automatically at the start of each billing period (monthly or yearly) until you cancel. Cancellation: monthly subscriptions may be cancelled at any time from your account page; cancellation stops the next renewal and you retain Pro features until the end of the current billing period. Annual subscriptions run for the full year once purchased; cancellation stops the next yearly renewal but does not refund the remainder of the current term, except as described below. Refunds: annual subscriptions include a 14-day money-back window beginning on the purchase date. Request a refund from your account page or by emailing info@bullionbidder.com within 14 days of purchase and we will refund the full annual amount and revoke Pro access. After the 14-day window, no refunds are issued for the remainder of the annual term except where required by applicable law (including Quebec's Consumer Protection Act). Monthly subscriptions are not refunded for the current month after the renewal date; cancellation stops the next charge. Auto-renewal: all subscriptions auto-renew at the price displayed at purchase, unless cancelled before the renewal date. You will receive an email receipt for each renewal. This auto-renewal arrangement is disclosed here in advance, in writing, as required by Quebec's Consumer Protection Act for distance contracts and similar foreign consumer-protection regimes. Price changes: we may change subscription prices for future billing periods with at least 30 days' notice by email and on the pricing page. Existing annual subscribers keep their current rate until the end of their current term. If you do not accept a price change, cancel before the next renewal. Effect of cancellation: when a paid subscription ends, your account reverts to the Free tier. Bid history entries and manual lot corrections you saved during the Pro period remain in your account and you can continue to view them; new tracking and overrides will be subject to Free tier limits. Catalogs you saved to your library are also kept. On the Free tier you keep your most recent saved catalog. Your existing saved catalogs stay until your next save, which then replaces them to fit the single-catalog Free limit. You may delete your records at any time from your account page. Switching to Free and changing tiers: cancelling is how you switch to Free; you are not locked out. You keep your paid tier through the end of the period you already paid for, then your account moves to the Free tier (the full analyzer with 400 credits per month). Your bid history and saved lot corrections stay with your account, but the Free tier keeps a single saved catalog, so your library is reduced to your most recent saved catalog on your next save. You can re-subscribe at any time. If you are on Pro Plus, you can also step down to Pro (rather than cancelling entirely) from the billing portal; the change takes effect at your next renewal and your current tier runs to the end of the paid period.

11. Free tier and credits

Usage is metered in credits: 1 credit covers one bullion-or-uncertain lot, and non-bullion lots do not consume credits. Re-processing a catalog you have already processed is free for 30 days from your first processing of it, for the lots that have not changed; after 30 days the cached result expires and re-processing consumes credits again. Each tier includes a monthly credit allowance (Free 400, Pro 2,000, Pro Plus 5,000). For paid tiers the allowance resets each month on your billing renewal date; for the Free tier it resets each month on the anniversary of your signup date. Allowances do not roll over. When you reach your monthly allowance, processing stops and tells you which lots were not evaluated. You can wait for the next reset or upgrade your tier at any time. The Free tier is offered at no charge and as a courtesy. We reserve the right to change, reduce, suspend, or discontinue the Free tier and its credit allowance, features, or limits at any time, with or without notice, including for any individual account where we detect abuse, automated use, or attempts to bypass rate limits or credit accounting. Paid subscribers receive the price-change and notice protections described in section 10.

12. Changes

We may update these Terms from time to time. Material changes will be highlighted on this page and, where applicable, communicated to registered users by email. Continued use after changes constitutes acceptance.

13. Governing law and forum

These Terms are governed by the laws of the Province of Quebec, Canada, excluding conflict-of-laws rules. Disputes will be brought before the courts of the judicial district of Montréal, except where exclusive jurisdiction is granted to consumer-protection or small-claims tribunals.
